Earlier this week the Firearms Policy Coalition (FPC) sent out an email:
We have an urgent legal update for all pistol brace owners regarding the injunction granted today in FPC’s case Mock v. Garland.
Following this morning’s 1-sentence injunction, our attorneys asked the court to clarify whether FPC members are protected by the injunction.
Here’s the message our Legal Team has asked us to pass onto the Grassroots Army:
“We cannot guarantee what the might Court might do in terms of clarifying the injunction. We will update FPC’s members as soon as the Court addresses our request for clarification, but we have asked the Court since day 1 to ensure FPC’s members are protected.”
Right now, an aggressive, expedited briefing schedule has been ordered by the court in FPC’s case. However, arguments are still slated to continue past the May 31st enforcement date.
Remember, on May 31st, which is in just 8 days, ATF will have full execute authority to target gun owners like you, Friend.
FPC’s Legal Team is working ’round the clock to determine the scope of today’s injunction and to protect as many peaceable people as possible from retaliation by the Federal Government.
And here’s the latest update:
The ATF’s ABSOLUTE WORST NIGHTMARE is unfolding before our very eyes: All FPC members are covered under the injunction.
However, we’re emailing everyone throughout the weekend because it’s VITAL that as many people as possible be covered under the injunction.
But if you haven’t become a member yet, make sure to do so IMMEDIATELY. Remember, all bets are off May 31st if you’re not covered.
This is great news. If you’re an FPC member, the ATF has been enjoined from enforcing their pistol brace rule against you. If you’re not a member, you can join FPC with a one time donation of $30.
There might be lots of reasons you might decide you don’t need to join FPC. Let’s go through them:
- You’ve gotten rid of your pistol braced firearm. The problem with this is that the ATF probably suspects that you still have it. They know that you didn’t register it as an NFA item, so you might be getting a visit.
- You’ve removed the pistol braced stock from the firearm, turning it into a compliant pistol. However, there’s no way for the ATF to know this either, so you might be getting a visit.
- You’ve never owned a pistol braced firearm. But, the ATF knows you’ve bought a lot of guns in the past, so they may suspect you’ve picked one up in a private sale. You might be getting a visit.
- You’ve sent in the paperwork to register your Short Barreled Rifle as an NFA item, but haven’t gotten an answer back. Too bad, now they know you have one and once the May 31st deadline has passed you’re in trouble, even if it’s their fault that they were slow in processing your paperwork. You might be getting a visit.
The ATF doesn’t have the staffing to send out agents to enforce this rule everywhere. They also have no idea of what the FPC membership list looks like. But if you’ve been a vocal critic of the ATF, you just might be getting a visit because they can decide who they’re going to prioritize. If you’re not an FPC member you’re taking a risk that an encounter could go sideways. The ATF’s record of shooting dogs is not great.
On the other hand, if you are an FPC member and the ATF shows up on your doorstep asking about your pistol brace, you can inform them they are in contempt of court if they don’t leave.
As I said before, don’t give them what they want. The best way to do that is to be able to cut any encounter with the ATF short by telling them to leave.
This case is not over. The injunction just means that the judge thought there was a likelihood of success. A battle was won, but the war continues. Joining the FPC is a great way to continue the fight. Unlike the NRA, the FPC actually gets things done for gun owners. While they do send out a lot of emails, the prose is entertaining and snarky. A small price to pay for the great pro-2A work that they do.
Join the FPC. Do it for dogs everywhere.
